1 Scope of Application

These Terms of Service govern the contractual relationship between Arctenic GmbH, Neukirchnerstr. 18, 65510 Hünstetten, Germany ("Provider") and users of the online service transcribinator.im ("User"). By using the service, the User agrees to these Terms.

2 Description of Service

The Provider offers an automated transcription and AI-based processing service for voice messages and message content originating from third-party messaging platforms including WhatsApp (Meta Platforms, Inc.), Telegram (Telegram FZ-LLC), and Signal (Signal Messenger LLC). The service may include transcription, summarization, structured formatting, and action item extraction. The Provider is not affiliated with, endorsed by, or officially connected to WhatsApp, Telegram, or Signal.

3 User Obligations

The User warrants that:

• They are legally permitted to upload and process the submitted content.
• All necessary consents from chat participants have been obtained.
• The uploaded content does not violate applicable laws or third-party rights.
• They comply with the terms of service of the respective messaging platform.

The User is solely responsible for the legality of processed content.

4 Billing and Payment

The service is provided on a usage-based pricing model (pay-per-minute). The applicable rate is displayed on the website at the time of use.

• No subscription or recurring monthly fee applies.
• Charges are calculated automatically based on processed audio duration.
• Billing occurs once the minimum billing threshold (e.g., EUR 0.50) is reached.
• Payment processing is handled via Stripe.

5 Availability

The Provider does not guarantee uninterrupted or error-free availability of the service. Maintenance, technical issues, or external factors may result in temporary interruptions.

6 AI and Accuracy Disclaimer

Transcriptions and summaries are generated using automated artificial intelligence systems. The Provider does not guarantee accuracy, completeness, or suitability for legal or professional use. The service does not constitute legal advice.

7 Limitation of Liability

The Provider shall be liable without limitation for intent, gross negligence, and injury to life, body, or health. In cases of slight negligence, liability is limited to foreseeable, contract-typical damages.

The Provider shall not be liable for:

• Loss of data caused by the User
• Indirect or consequential damages
• Account suspensions or restrictions imposed by WhatsApp, Telegram, or Signal

8 Termination

Users may stop using the service at any time. The Provider reserves the right to suspend or terminate access in case of violations of these Terms.

9 Intellectual Property

Users retain ownership of submitted content. The Provider retains all rights to the underlying software, systems, and algorithms used to provide the service.

10 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. If the User is a merchant, the place of jurisdiction shall be the registered office of the Provider.

11 Severability Clause

If any provision of these Terms is invalid, the remaining provisions shall remain unaffected.
